I need help with a somewhat complicated situation, am in the process of moving and desperately need a bit of help please.
I am from Denmark, where spearfishing is legal and one does not need a permit to own such equipment. I currently live in Singapore, where I need a permit to own spearfishing equipment. I have a couple of such pieces, and the permit for them. Am in the process of moving to Cayman, where it is totally illegal to even own spareparts for such equipment. I had hoped that I could send the stuff over to family in Toronto, as I plan to vacation in Canada, and hoped to spearfish there. Can you please advise as to whether it is illegal to possess such equipment in Ontario? I mean, do the regulations specify that you cannot own, or just that you cannot use the equipment? My reason for asking is - can I send the stuff over to the family, pick it up and go to Quebec and do some spearfishing? I am due to move in a few days, have been grappling with the issue and really need help. Another issue is that neither the postoffice nor fedex will transport the items for me. I plan to travel Singapore-Cayman, and the only option I seem to have right now is to destroy the equipment! |

Hello,
You aren't allowed to spearfish in Ontario at all. ![]() I believe the regulations are you can own a spear gun but if you get caught within 100 meters from water you can get charged. When are you coming to Toronto? |

Right, so spearfishing isn't allowed in Ontario.
Where can I find the regulation stating that my family can store/own the spearguns without using them in Ontario? I need to have this so as not to get them in trouble. Can you help me with this please. I plan to visit later this later and will take the spearguns over to Quebec or whatever and use them there. What did you have in mind. |

As far as I know it is not illegal to own a speargun in Ontario nor it requires any registration. Gun control regulation seems to be under federal authority and I suspect is the same in all provinces. I bought spearguns overseas and have them delivered in Canada (Quebec) without any trouble. I had to pay customs duties equivalent to the sales tax here (15%).
If still worried have a look at the Canada Border Services Agency site and on particular at documents concerning importing non-commercial goods (see for example: http://www.cbsa-asfc.gc.ca/E/pub/cp/...rc4051-e.html). I doubt they have anything specifically allowing spearguns to enter the country (and yes, this doesn't make it illegal as Strangelove mentioned). You may also contact them by phone and ask for clarifications. Good luck. Virgil |
